Terms of sale and use

Last updated: October 9, 2026

These terms govern the contract between Emailzeta LLC (the “Provider”) and any person or company that creates an account, buys credits or uses the IberiaData API (the “Customer”).

1. Purpose and acceptance

The Service consists of a directory of companies and professionals and the possibility of unlocking professional contact details (email and telephone) with credits, through the website or the API. Provider: Emailzeta LLC, a limited liability company organised under the laws of the State of Wyoming (United States), with registered address at 30 N Gould St, Ste R, Sheridan, WY 82801, USA.

By creating an account, buying credits or using the API you accept these terms. If you act on behalf of a company, you confirm that you are authorised to bind it. The Service is aimed at professional use (B2B).

2. Account and security

You must provide truthful information and keep your password and API keys confidential. You are responsible for the activity carried out with your account and keys. Notify us immediately of any unauthorised use.

Each organisation must have its own account; sharing credentials or API keys between different organisations is not allowed.

3. Licence of use and no-resale clause

Each unlock grants the Customer a non-exclusive, non-transferable and non-sublicensable licence to use the data obtained exclusively in its own internal business activity. Data are not sold: a right of use is granted, and ownership of the database remains with the Provider.

The Customer may NOT, in whole or in part, directly or through third parties:

  • resell, rent, assign, license or otherwise commercialise the data;
  • share, publish or make them available to third parties (including other group companies, clients or partners), except to processors acting on its behalf and for its own use;
  • incorporate them into databases, lists, directories, products or services offered to third parties, or use them to build a competing product;
  • extract data massively by automated means outside the API, or circumvent usage limits.

We may include control records in the data to detect unauthorised redistribution.

4. Lawful use of the data

The Customer acts as an independent controller of the personal data obtained and is solely responsible for using them in accordance with the GDPR, the LOPDGDD and the LSSI-CE. Among other things, it must: inform the data subject of the origin of the data at the first communication (Art. 14 GDPR), respect the right to object and keep its own suppression list, and obtain consent where the law requires it to send commercial communications by electronic means.

The Service may not be used to send spam, for fraud or harassment, or for any unlawful purpose. The Customer shall indemnify the Provider against any claim arising from its use of the data.

5. Credits, prices and payment

Web credits (used on the website) and API credits (used through the API) are separate balances, bought in advance in packs. For the same spend, both have the same value per detail; larger packs include bonus credits. The cost in credits of each detail is shown before confirming any unlock.

Missing data are never charged. A detail already unlocked by the account can be consulted again free of charge, also when it is updated later.

Credits do not expire. There are no subscriptions or automatic top-ups. Welcome offers are limited to the first purchase of each organisation; add-ons offered at checkout are optional.

Prices are shown in euros and are the final amount charged; no taxes are added on top. Payment is made by card or other methods through Stripe; the Provider does not store card details.

Invoices are issued in the name of the billing details entered in the account.

6. Right of withdrawal and refunds

If you are a consumer, you have 14 calendar days from purchase to withdraw from it with respect to credits you have not used, by writing to info@emailzeta.com. The refund will be made by the same payment method within 14 days.

Unlocking a detail is digital content supplied immediately: by unlocking it you expressly consent to the start of performance and acknowledge that you lose the right of withdrawal for the credits consumed.

Professional customers: credits are not refundable, except where the law requires otherwise or in the case of a technical error attributable to the Provider.

7. Data quality and availability

Directory data come from sources accessible to the public and from information published by the companies and professionals themselves, and undergo technical validation (domain and numbering checks). We do not guarantee that every contact is current, direct or active.

Records may be corrected or removed at any time, in particular at the request of data subjects. A removed record stops being available even if it had been unlocked; the purchase history is kept.

We aim for high availability but do not guarantee uninterrupted service. API limits (requests per minute and per day) are set out in the documentation and may be adapted per account.

8. Suspension and termination

The Customer may close its account at any time. The Provider may suspend or close accounts and revoke API keys in case of breach of these terms (in particular, the no-resale clause or abusive use), without refund of the remaining balance and without prejudice to claiming damages. After closure for breach, the Customer must delete the data obtained.

9. Liability

The Service is provided “as is”. To the extent permitted by law, the Provider is not liable for indirect damages or lost profits, and its total liability is limited to the amount paid by the Customer in the twelve months prior to the event giving rise to it. These limits do not apply in cases of wilful misconduct or gross negligence, nor do they limit the mandatory rights of consumers.

10. Changes, applicable law and jurisdiction

We may update these terms; relevant changes will be notified in advance and will not affect purchases already made. Continued use after notification implies acceptance.

These terms are governed by the laws of the State of Wyoming (United States). For professional customers, the courts of the State of Wyoming shall have jurisdiction. Consumers resident in the European Union keep the protection of the mandatory provisions of their country of residence and may sue in their courts.
